'Notwithstanding any other law, for the state fiscal biennium beginning September 1, 2025, the amount spent for purposes of the program may not exceed $1 billion. This subsection expires September 1, 2027.' From then on the amount is what the Legislature appropriates for the biennium (§29.3521).

Islamic schools and parents sued over their exclusion from the program. On March 17, 2026 the court granted a temporary restraining order in part, and the application deadline was extended to March 31, 2026. Cherkaoui v. Paxton (4:26-cv-01675) was consolidated into this case the same day. On June 18, 2026 the plaintiffs filed a notice passing the preliminary-injunction hearing, and the court cancelled the hearing on June 21. The state's motion to dismiss (June 26, 2026) is pending. The June 12, 2026 scheduling order sets a jury trial for July 12, 2027; on October 2, 2026 the parties filed an agreed motion to modify that schedule, so the trial date may change.

The Comptroller's Legislative Appropriations Request asks for $2,075,625,000 base for 2028-29 plus $226,000,000 exceptional items. As the law requires, it also states the cost of three groups: $916 million to continue the current participants, $980 million for the 106,127 children on the waitlist and an estimated $82 million for eligible siblings (Community Impact reports these as amounts per year). Community Impact reports that the base request "would not fully cover the waitlist and interest list". Interest list: over 44,000. A hearing on the request was held Sep 9, 2026.

A private school must be accredited by a body recognized by the Texas Private School Accreditation Commission or by TEA, have operated a campus for at least two years, administer a nationally norm-referenced assessment, and be located in Texas (virtual schools: an office in Texas). A provider of a pre-K or kindergarten program joins on another rule: it must be located in Texas, be licensed by and in good standing with the Texas Department of Family and Protective Services, and meet one of five further conditions listed on the official Schools page. Schools apply through Odyssey's school portal on a rolling basis.
