    $1 billion cap on 2025-27 TEFA spending expires Sep 1, 2027

    'Notwithstanding any other law, for the state fiscal biennium beginning September 1, 2025, the amount spent for purposes of the program may not exceed $1 billion. This subsection expires September 1, 2027.' From then on the amount is what the Legislature appropriates for the biennium (§29.3521).

    The 2025-27 cap ends; 2027-29 funding is set by appropriation.

    Litigation: Bayaan Academy v. Hancock, 4:26-cv-01960 (S.D. Tex.) — motion to dismiss pending; trial set Jul 12, 2027

    Islamic schools and parents sued over their exclusion from the program. On March 17, 2026 the court granted a temporary restraining order in part, and the application deadline was extended to March 31, 2026. Cherkaoui v. Paxton (4:26-cv-01675) was consolidated into this case the same day. On June 18, 2026 the plaintiffs filed a notice passing the preliminary-injunction hearing, and the court cancelled the hearing on June 21. The state's motion to dismiss (June 26, 2026) is pending. The June 12, 2026 scheduling order sets a jury trial for July 12, 2027; on October 2, 2026 the parties filed an agreed motion to modify that schedule, so the trial date may change.

    Final 2026-27 installment — Feb 1, 2027

    The remaining 50% of the 2026-27 private-school award is released on February 1, 2027 to students still enrolled at a participating school.

    The private-school award is '85 percent of the estimated statewide average amount of state and local funding per student in average daily attendance'. The commissioner must 'make the determination not later than January 15 preceding the school year', so the 2027-28 amount is due by January 15, 2027. The 2026-27 amount was $10,474.

    90th Texas Legislature: Jan 12 – May 31, 2027 — decides 2027-29 TEFA funding

    The regular session that sets the 2028-29 budget (and any change to award amounts or eligibility) opens January 12, 2027 and ends May 31, 2027. As of Oct 8, 2026 the Comptroller's site gives no dates for the 2027-28 application window.

    Private-school awards are paid 25% on July 1, 25% on October 1 and the remaining 50% on February 1, provided the student stays enrolled at a participating school.     Students had to confirm enrollment in a participating private school, or opt in as homeschool/other, by September 15 to receive the full award. Students taken off the waitlist after July 15 may have their funding prorated by the date they confirm.

    Funding request for 2028-29: $2,301,625,000 (Comptroller LAR, Aug 2026)

    The Comptroller's Legislative Appropriations Request asks for $2,075,625,000 base for 2028-29 plus $226,000,000 exceptional items. As the law requires, it also states the cost of three groups: $916 million to continue the current participants, $980 million for the 106,127 children on the waitlist and an estimated $82 million for eligible siblings (Community Impact reports these as amounts per year). Community Impact reports that the base request "would not fully cover the waitlist and interest list". Interest list: over 44,000. A hearing on the request was held Sep 9, 2026.
